The affidavit for continuance, the refusal of which is the only ‍‌‌​‌‌​​‌​‌‌​‌‌‌‌‌‌​​​​‌‌​‌​​​‌‌​‌​​​​‌‌​​‌‌​‌‌​​​‌​‌​‌‌‌‌‌​‌‌​‌​‌‌‌‌‌‌​​​​‌​‌‌‌​‌​‌‌​​​‌‌‌​‌‌​‌‌‍error assigned, is fatally defective in this: that it fails to aver ‍‌‌​‌‌​​‌​‌‌​‌‌‌‌‌‌​​​​‌‌​‌​​​‌‌​‌​​​​‌‌​​‌‌​‌‌​​​‌​‌​‌‌‌‌‌​‌‌​‌​‌‌‌‌‌‌​​​​‌​‌‌‌​‌​‌‌​​​‌‌‌​‌‌​‌‌‍inability to prove the facts referred to otherwise than by the witnesses ‍‌‌​‌‌​​‌​‌‌​‌‌‌‌‌‌​​​​‌‌​‌​​​‌‌​‌​​​​‌‌​​‌‌​‌‌​​​‌​‌​‌‌‌‌‌​‌‌​‌​‌‌‌‌‌‌​​​​‌​‌‌‌​‌​‌‌​​​‌‌‌​‌‌​‌‌‍■of whose absence he complains.
