STATE of Louisiana
v.
Terrance JOHNSON.
Supreme Court of Louisiana.
PER CURIAM:
Granted. The trial court erred in granting the defendant's motion to suppress the evidence, and this case is remanded to that court for further proceedings consistent with the views herein.
Given the preference for searches conducted under the authority of a warrant issued by a magistrate who has made "a practical, commonsense decision... [that] there is a fair probability that contraband or evidence of a crime will be found in a particular place," the task of a reviewing court "is simply to ensure that the magistrate had a `substantial basis for *547... conclud[ing]' that probable cause existed." Illinois v. Gates,
CALOGERO, C.J., would grant and docket.
