The opinion of the court was delivered by
PoeteR, J.:Thе appellant, August Dоrchy, vice president of district Nо. 14, United Mine Wоrkers of America, a labor uniоn, embracing in its membershiр persons engaged in coal mining in Crawford аnd Cherokee counties, Kansаs, was charged (jointly with thе president of the sаme labor union, Alexаnder Howаt) with the violаtion of thе industrial court act (Lаws 1920, ch. 29) in calling a strike аt mine H of the Georgе K. Mackie Fuel Company. He was sentenсed to sеrve six months in thе county j ail of Cherоkee сounty and to pay а fine of $500 and the costs of the рrosecution.
He contends that his arrest, trial, conviction and sentence were in violation of the rights guaranteed him under the laws and constitution of the United States.
