LEMMON, J., concurs, believing the ‍​‌‌​​‌​‌​‌‌‌​​​‌‌​​‌‌​‌‌‌‌​‌​​‌‌‌‌‌‌‌‌‌​‌‌‌​‌‌‌‌‌‌​​‌‌‌‌​​‌‌​​​‌‌‌‌​​‌‌​‌​​‌​‌‌‌​‌‌‌​​​‌‌​​​‌​‌​‍court of appeal erred as to assignments ‍​‌‌​​‌​‌​‌‌‌​​​‌‌​​‌‌​‌‌‌‌​‌​​‌‌‌‌‌‌‌‌‌​‌‌‌​‌‌‌‌‌‌​​‌‌‌‌​​‌‌​​​‌‌‌‌​​‌‌​‌​​‌​‌‌‌​‌‌‌​​​‌‌​​​‌​‌​‍of error Nos. 1 and 8, but ‍​‌‌​​‌​‌​‌‌‌​​​‌‌​​‌‌​‌‌‌‌​‌​​‌‌‌‌‌‌‌‌‌​‌‌‌​‌‌‌‌‌‌​​‌‌‌‌​​‌‌​​​‌‌‌‌​​‌‌​‌​​‌​‌‌‌​‌‌‌​​​‌‌​​​‌​‌​‍the error was harmless.
