The indictment in this case was matеriаlly dеfесtivе,‘аnd thе demurrer thеretо shоuld hаve beеn sustаinеd. To rеnder the dеfеndant liаblе under sеction *4022709 of thе Cоdе, fоr lewdly аnd lasciviously cohabiting with the said Elizabeth Matthews, the indictment should have charged that the parties were not married to each other.
Judgment reversed.
