LEMMON, J.,

would grant to consider whether the Legislature’s ‍​​‌​‌‌‌‌​‌​​​‌​‌‌‌‌​​‌​​‌​‌‌‌‌​​​​​‌​​‌‌​​​‌​​‌​‌‌​​‌​​‌‌​​‌​‌​‌‌​​​​‌​‌‌‌‌​​​​​​​​‌​​‌​​‌‌‌‌‌‌​‍defining the exact conduct in this case as a crime with a maximum ten-year sentence ‍​​‌​‌‌‌‌​‌​​​‌​‌‌‌‌​​‌​​‌​‌‌‌‌​​​​​‌​​‌‌​​​‌​​‌​‌‌​​‌​​‌‌​​‌​‌​‌‌​​​​‌​‌‌‌‌​​​​​​​​‌​​‌​​‌‌‌‌‌‌​‍sets the maximum non-excessive sentence in this case.
