Montgomery No. 24001, 2013-Ohio-2230. O’Connor, C.J., and O’Donnell, J., concur but would ‍‌​‌‌​​​​​‌‌‌‌​‌‌‌​​‌​‌‌‌​​‌​​​‌‌‌​‌‌​​​‌‌​‌‌‌‌‌​‍grant the motion as to both propositions of *1415law.
