McClendon (this day decided) 43 ‍‌‌​​​‌​‌​​‌​‌‌​‌‌​‌​‌​‌​‌​‌‌​‌​​​‌‌‌​‌​​​​​​​‌‌​‌‌​​​‌​‌‌‌​‌​​‌‌​‌​​​‌‌‌​​‌‌‌‌‌​​‌​​‌‌​​‌​‌‌​​​‌‍South. 4171; and, for the reasons assigned ‍‌‌​​​‌​‌​​‌​‌‌​‌‌​‌​‌​‌​‌​‌‌​‌​​​‌‌‌​‌​​​​​​​‌‌​‌‌​​​‌​‌‌‌​‌​​‌‌​‌​​​‌‌‌​​‌‌‌‌‌​​‌​​‌‌​​‌​‌‌​​​‌‍in that case, the judgment herein appealed from ‍‌‌​​​‌​‌​​‌​‌‌​‌‌​‌​‌​‌​‌​‌‌​‌​​​‌‌‌​‌​​​​​​​‌‌​‌‌​​​‌​‌‌‌​‌​​‌‌​‌​​​‌‌‌​​‌‌‌‌‌​​‌​​‌‌​​‌​‌‌​​​‌‍is affirmed.
