Lead Opinion

In re: Nolan James applying- for Writ of Mandamus and Stay Order.

Writ refused. The ruling of the trial judge is correct. See Daniel v. Louisiana, 420 U.S. 31, 95 S.Ct. 704, 42 L.Ed.2d 790 (1975).

Dissenting Opinion

BARHAM, J.,

is of opinion the writ should be granted. The Grand Jury should be reconstituted or this and similar cases face reversal after trial and conviction. Daniel v. Louisiana, 420 U.S. 31, 95 S.Ct. 704, 42 L.Ed.2d 790 does not support the denial of the writ here.
