1. The assignment of error in this case, that the judge failed to charge the jury on the defense of alibi, is without merit, since there was no timely written request for such a charge, and since there was no evidence of such clear and strong probative value as to alibi as would require instruction from the court upon such a defense. See Paulk v. State, 8 Ga. App. 704 (2), and cases cited.
3. The evidence authorized the conviction of the defendant, the verdict has the approval of the trial judge, and for no reason assigned was it error to overrule the motion for a new trial.
Judgment affirmed.
