State, 46 Ala.App. ‍​‌‌​‌​​​​‌‌​​​‌​​​‌​‌​‌​​‌​​​​​‌​​​​​‌‌​‌​​‌​‌​‌‌‌‌‌​​‌‌​‌​‌​‌‌​‌‌‌‌‌‌‌‌​​​‌​​​​‌​‌​‌‌​​​​‌​​‌‌‌‍357, 242 So.2d 403 (7 Div. 9).
