Plaintiff claims title to seven forty-acre tracts of land, described in his petition, by virtue of the act of congress, approved September 28, 1850, and acts of the general assembly of the state of Iowa, relating to swamp lands. Defendant claims title to the same land by virtue of the act of congress, approved May 15, 1856, granting to the state of Iowa certain lands to aid in the construction of- a railroad from Dubuque to a point on the Missouri river, near Sioux City, and other roads, and by virtue of the acts of the general assembly of the. state' of Iowa. The district court found that plaintiff was the owner of the land in question, and quieted his title thereto as against defendant.
