We granted the application for writ of certiorari to review the decision and judgment of the Court of Appeals in
Smith v. Telecable of Columbus,
The Court of Appeals held that while in its opinion the trial judge erroneously granted the defendant’s motion for new trial on a special ground related to the charge, the appellate court was without authority to review the ruling. The holding was based upon
Weinkle v. Brunswick &c. R. Co.,
"The first grant of a new trial will not be disturbed by this court where the new trial is granted in the discretion of the trial judge on the general grounds, unless the appellant shall show that the trial judge abused his discretion in granting it and that the law and the facts require the verdict notwithstanding the judgment of the trial court. Code Ann. §
