This is an application by C. H. Miller, a former commissioner, to have the Court consider and pass upon certain exceptions noted by him in the progress of the case in the court below, on the ground that on appeal the cause had been retained and was now in this Court for the purpose indicated. The appeal referred to is reported in

For the reasons stated the application on the part of C. H. Miller must be denied.
