dissenting.

Adhering to my view that the death ‍‌‌‌‌​​​‌​‌​‌​​‌​​​‌​‌‌​​‌​‌​​​‌​​‌‌​‌‌‌​​​‌‌‌​​​​​​​​​‌​​‌‌​‌​‌‌​​​​‌‌‌‌‌​‌‌‌‌​‌‌‌‌​‌‌​​‌​​‌​​‌‌‍penalty is in all circumstances cruel and unusual punishment prohibited ‍‌‌‌‌​​​‌​‌​‌​​‌​​​‌​‌‌​​‌​‌​​​‌​​‌‌​‌‌‌​​​‌‌‌​​​​​​​​​‌​​‌‌​‌​‌‌​​​​‌‌‌‌‌​‌‌‌‌​‌‌‌‌​‌‌​​‌​​‌​​‌‌‍by the Eighth and Fourteenth Amendments, Gregg v. Georgia, 428 U.
