ORDER

Plaintiff, a state prisoner, appeals the sua sponte dismissal of his civil rights complaint brought under 42 U.S.C. Sec. 1983. Plaintiff also moves for pauper status on appeal. The case has been referred to a panel of the Court pursuant to Sixth Circuit Rule 9(a). Upon examination of plaintiff's brief and the record, the panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure.

Accordingly, it is ORDERED that the motion to proceed in forma pauperis is granted. The district court's judgment is vacated and the case is amended for further proceedings consistent with Tingler v. Marshall, supra. Rule 9(d)(4), Rules of the Sixth Circuit.
