Lead Opinion

In Re William H. “Billy” Scoggins, applying for writ of Certiorari and/or Review to the Second Circuit Court of Appeal, Number 16,172-CA; Fifth Judicial District Court, Parish of West Carroll, Number 17,-338.

Case Below: 442 So.2d 1202.

Denied. The result is correct.

LEMMON, J., dissents and assigns reasons.

Dissenting Opinion

LEMMON, Justice,

dissenting from denial of certiorari.

The “but for” standard of proof in election cases is unreasonable. In enacting the election code, the Legislature probably intended to change the standard, but in any event this court should do so. I would grant certiorari for that purpose.
