This case involves the validity of an act -of the General Assembly approved March 1, 1903 (Acts 1903, p. 193, §§4983h-4:983s Burns 1905), relative to the creation of library boards in cities of a certain population. Otherwise stated, the controversy is between the school city of Marion, on the one hand, and the appellees, who claim as members of the library board of the civil city, appointed under the provisions of said act.
Judgment affirmed.
