DIXON, J., cоncurs in the denial although it is аn irreparаblе injury to deny a trial by jury, and such a denial is ‍​‌​​‌‌​‌​‌​​​‌‌​‌‌‌​​‌‌‌​‌​‌​​​​‌​‌​​​​​​‌​​​‌‌​‍appealable, it would be vain and useless in this case, since there is no right to a jury trial in a partition suit.
