The petition of the plaintiffs, bringing'complaint for land in the statutory form, was duly paragraphed. The petition described a tract of 130 acres of land, and described the land sued for as “40 acres of the northern part of said tract of land.” There was no other description of the 40 acres sued for, in the pleadings or in the evidence. Plaintiffs alleged a statement of facts, in lieu of an abstract of title, in which they set forth that the land contended for was purchased from Kufus Wren by their father, Isaac Allen, in 1866 or 1867, and that the latter from that date until his death in 1897 was in peaceable, quiet, and uninter
The judgment of the court below is
