1. The bill of exceptions contains the following assignment of error: “At the conclusion of the introduction of the aforesaid testimony by the plaintiff, defendant moved the court to grant a nonsuit, which the court refused. After said refusal of the court to order a non- ■ suit the trial proceeded with introduction of evidence by defendant and by plaintiff in rebuttal. A verdict and judgment were rendered in favor
2. The plaintiff’s evidence submitted before the motion for a nonsuit was made substantially proved the case as laid in the petition, and the court did not err in overruling the motion. Judgment affirmed.
