The requirement of a timely filed notice of appeal is jurisdictional, even as to criminal cases, and, absent an extension, upon the failure to file such notice within 30 days after a judgment becomes final the appeal must be dismissed. McMURRAY, Presiding Judge, dissenting.

I am unable to agree with the majority's holding that the appeal should be dismissed as it is my view that the case sub judice is controlled by the decision in Evitts v. Lucey, 469 U.S. 387" date_filed="1985-03-18" court="SCOTUS" case_name="Evitts v. Lucey">469 U.S. 387 (105 SC 830, 83 LE2d 821), and should be decided on the merits.
