The testimony of plaintiff disclosed that he took the bill of sale only for the purpose of saving' himself
instruction. “The instrument or bill of sale from Gfeorge Worland to John H. Worland being absolute upon its face and plaintiff John H. Worland by his evidence admitting it was intended as a security for $600, and that the stock of goods was worth $1,200 to $1,400, such instrument became and was fraudulent in law and the verdict will be for the defendant.” The jury returned a verdict in favor of defendant.
Plaintiff after unsuccessful motions for new trial and in arrest appealed to this court.
