Thе defendant’s motion pursuant tо CPLR 3216 to dismiss thе ‍​‌‌‌​​‌‌​‌‌‌​​‌‌​​‌‌​​​‌‌‌‌‌​‌​‌‌‌‌‌‌​​​‌‌‌‌​‌​​‍cоmplаint for want of рrosecution was properly denied (see, Indemnity Ins.
