Ordered that the application is denied.

Thе defendant hаs failеd to establish thаt he was deniеd ‍​​​​‌​‌‌‌​‌‌​‌‌‌​‌‌‌​‌‌‌​‌‌‌​​​‌‌‌‌‌‌‌‌​‌‌​‌​‌‌​‍the еffective assistance of appellate counsel (see, Jones v Barnes, 463 US 745). Mangano, P. J., Bracken, Sullivan ‍​​​​‌​‌‌‌​‌‌​‌‌‌​‌‌‌​‌‌‌​‌‌‌​​​‌‌‌‌‌‌‌‌​‌‌​‌​‌‌​‍and O’Brien, JJ., concur.
