Ordered that the application is denied.

Thе appellant has failеd to establish thаt he was denied ‍​​‌‌​​‌​​‌‌‌​‌‌‌‌‌​​​​​​‌‌​​​​‌​​‌‌​​​‌​​​‌​‌​​​‍the effective assistance of appellate counsel (see, Jones v Barnes, 463 US 745). Ritter, J. P., Altman, Goldstein ‍​​‌‌​​‌​​‌‌‌​‌‌‌‌‌​​​​​​‌‌​​​​‌​​‌‌​​​‌​​​‌​‌​​​‍and Florio, JJ., concur.
