Appeal by the defendant from a judgment of the Supreme Court, Kings County (Parker, J.), rendered September 3, 2008, convicting him of murder in the second degree and criminal possession of a weapon in the second degree, upon a jury verdict, and imposing sentence.

The defendant’s remaining contention regarding his conviction of criminal possession of a weapon in the second degree is without merit (see People v Pons, 68 NY2d 264, 265 [1986]; People v Almodovar, 62 NY2d 126, 130 [1984]; People v Khan, 113 AD2d at 774; but see People v Aruz, 253 AD2d 592, 595 [1998]).
