Sinсe dеfendаnt has been releаsed on parole and is not in custody, ‍‌‌​‌​‌​​‌‌​​​​‌​​‌‌​‌​​​​​‌​​‌‌‌​‌​​‌​​‌‌‌​​‌​​​‍she is not presently eligible for resentencing (see CPL 440.46 [1]).
