Appeal from a judgment of the Niagara County Court (Sara S. Sperrazza, J.), rendered November 9, 2000. The judgment convicted defendant, upon a jury verdict, of attempted burglary in the third degree and criminal mischief in the third degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
Memorandum: Defendant appeals from a judgment convicting him after a jury trial of attempted burglary in the third degree (Penal Law §§ 110.00, 140.20) and criminal mischief in the third degree (former § 145.05). Contrary to the contention of defendant, County Court properly denied his motion for a mistrial premised on an alleged violation of the court’s Ventimiglia ruling. Indeed, defendant elicited the disputed testimony during cross-examination of one of the People’s witnesses (see People v Hernandez,
