Appeal from a judgment of the County Court of Schenectady County, rendered November 27, 1978, upon a verdict convicting defendant of the crime of criminal possession of a weapon in the fourth degree. Defendant was indicted for the crimes of criminal possession of stolen property in the second degree and criminal possession of a weapon in the fourth degree. After a jury trial, he was found not guilty of the first charge but guilty of the second one. He was sentenced to six months in the county jail. This appeal ensued and defendant raises several issues urging reversal. A brief recitation of the evidence is necessary to understand these issues. The prosecution’s first witness, one Brown, testified that he was the owner of the gun in question and that his home had been broken into and the gun stolen. An undercover officer testified that he purchased the gun in question from defendant. Much of the latter’s testimony was corroborated by the third and final witness for the prosecution. Defendant did not testify nor did he offer any proof. Initially, we reject defendant’s contention that the verdict is contrary to the weight of the evidence. We also reject defendant’s contention that the court improperly marshaled the evidence. We now pass to defendant’s contention that the court improperly charged the jury with respect to defendant’s exercising his right not to take the stand. An examination of the charge demonstrates that the court instructed the jury on circumstantial evidence and told them to apply the test he mentioned in considering such evidence as to the knowledge of defendant as to whether the property was stolen.
