Ordered that the judgment is modified, on the law, by reversing the conviction of kidnapping in the second degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
We find that the trial court erred in declining to merge the defendant’s kidnapping conviction into his assault and attempted rape convictions (see, People v Gonzalez,
Viewing the evidence of the other charges in the light most favorable to the prosecution (see, People v Contes,
Equally without merit is the defendant’s contention that the trial court violated his right to confront the witnesses against him by limiting his cross-examination of the complainant. Despite the court’s limitation, the defendant was able to sufficiently probe the intended area of inquiry and explore the veracity of the complainant’s direct testimony (see, People v Chin,
The defendant’s remaining contention is without merit.
