—Appeal from a judgment of Yates County Court (Falvey, J.), entered February 9, 1999, convicting defendant after a jury trial of, inter alia, burglary in the second degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
Memorandum: Defendant appeals from a judgment convicting him after a jury trial of burglary in the second degree (Penal Law § 140.25 [2]) and petit larceny (§ 155.25). By presenting evidence after County Court’s implicit denial of his motion to dismiss at the close of the People’s case and in failing to renew his motion, defendant waived review of the court’s denial of that motion (see People v Hines,
