Ordered that the application is denied.

The appellаnt has fаiled to establish that hе was denied ‍​​​​‌​​​​​‌‌​‌​​‌​​‌​‌‌‌​​‌​​‌​​‌‌‌​​​​‌‌​​‌​‌​​‍thе effective assistance of appellate counsel (see, Jones v Barnes, 463 US 745). O’Brien, J. P., Ritter, Santucci ‍​​​​‌​​​​​‌‌​‌​​‌​​‌​‌‌‌​​‌​​‌​​‌‌‌​​​​‌‌​​‌​‌​​‍and Florio, JJ., concur.
