Motion by respondent to dismiss appeal from an order of the 'County Court, Nassau County, dated January 6, 1961, denying appellant’s motion to direct a jury trial of the issues raised in his coram nobis application. Motion granted; appeal dismissed. The order is an intermediate order in the proceeding, which is not appealable (cf. Code Grim. Pro., § 517). Nolan, P.
