—Appeal by the defendant from a judgment of the Supreme Court, Kings County (Douglass, J.), rendered April 17, 1998, convicting him of burglary in the first degree, criminal trespass in the second degree, and attempted assault in the third degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is modified, on the law, by vacating the conviction of criminal trespass in the second degree, vacating the sentence imposed thereon, and dismissing that count of the indictment; as so modified, the judgment is affirmed.
