— Appeal by the defendant from a judgment of the County Court, Nassau County (Thorp, J.), rendered May 5, 1986, convicting him of murder in the second degree (two counts), robbery in the first degree, and criminal possession of stolen property in the second degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The defendant’s claim that he was denied a fair trial because the court refused to allow a defense witness to take the stand solely for the purpose of invoking his Fifth Amendment rights in the presence of the jury and refusing to testify is without merit.
