Judgment, Supreme Court, New York County (Joan Sudolnik, J.), rendered October 29, 1997, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him, as a second felony offender, to a term of 5 to 10 years, unanimously affirmed.
The jury’s verdict rejecting defendant’s agency , defense was based on legally sufficient evidence and was not against the weight of the evidence. There is no basis upon which to disturb the jury’s determinations concerning credibility. The evidence established that defendant acted primarily for his own benefit in promoting the sale, and that the benefit he received cannot be described as incidental (see, People v Lam Lek Chong,
The court’s agency charge, read as a whole, conveyed the proper standards, in that the court correctly instructed the jury that it could consider a benefit received from the buyer as supportive of an agency defense (People v Job,
Defendant’s remaining contentions are unpreserved and we decline to review them in the interest of justice. Were we to review these claims, we would reject them. Concur — Rosenberger, J. P., Tom, Mazzarelli, Andrias and Saxe, JJ.
