It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified as a matter of discretion in the interest of justice and on the law by reversing those parts convicting defendant of three counts of rape in the third degree under counts 9, 12 and 14 of the indictment and dismissing those counts of the indictment and as modified the judgment is affirmed.

Defendant further contends that the evidence is legally sufficient to support the conviction of only one of the two counts of rape in the third degree under counts seven and nine of the indictment. We also reject defendant‘s contention that the court abused its discretion in refusing to give a missing witness charge. “[T]here is ample support in the record that the missing [police] officer‘s testimony would have been cumulative,” and thus a missing witness charge was not warranted with respect to that officer (People v Macana, 84 NY2d 173, 180 [1994]). In any event, any error in the court‘s refusal to give a missing witness charge is harmless (see People v Cato, 306 AD2d 912, 913 [2003], lv dismissed 1 NY3d 569 [2003]; see generally People v Crimmins, 36 NY2d 230, 241-242 [1975]).
