THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v EDWARD CIESLEWICZ, Appellant. [845 NYS2d 590]—Appeal from a judgment of the Erie County Court (Michael L. D‘Amico, J.), rendered July 13, 2006. The judgment convicted defendant, upon his plea of guilty, of robbery in the second degree (two counts) and burglary in the third degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by reversing that part convicting defendant of burglary in the third degree and dismissing count two of the superior court information and as modified the judgment is affirmed.
