People v. CarsonPeople v. Carson
Ordered that the judgment is affirmed.
Viewing the evidence in the light most favorable to the prosecution (see People v Contes, 60 NY2d 620, 621 [1983]), we find that it was legally sufficient to establish the defendant’s guilt of assault in the third degree beyond a reasonable doubt, including that he caused “physical injury” to the complainant (
The audio recording of the 911 call that the complainant made after the attack was properly admitted as a present sense impression (see People v Buie, 86 NY2d 501, 506 [1995]; People v Brown, 80 NY2d 729, 732 [1993]).
The defendant’s remaining contentions are without merit.
