Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered January 7, 1977,' convicting him of manslaughter in the first degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial of the defendant’s motion to suppress certain statements. By order of this court dated January 28, 1980, the case was remanded to Criminal Term to hear and report on whether defendant’s arrest was supported by probable cause, and if it was not, whether defendant’s statements must be excluded as the fruit of the illegal detention or whether there was sufficient attenuation to sustain the admissibility of the statements.
