Ordered that the application is denied.

Thе defendant hаs failed to establish thаt he was denied ‍‌‌‌‌​‌‌‌​‌​​‌‌​‌‌​‌​​​​​​‌‌​​​​​​​​​‌​‌​‌​​‌​​​​‍the effective assistance of appellate counsel (see, Jones v Barnes, 463 US 745). Bracken, J. P., Ritter, Thompson and Sullivan, JJ., concur.
