The respondent Brice was, in the year 1899, a member of the council of the city of New York. On the twenty-second of July of that year a writ of peremptory mandamus was duly issued out of this court directed to the said council and the board of aldermen, together constituting “ the municipal assembly of the city of New York,” commanding said council and board of aldermen to forthwith assemble and authorize the comptroller of the city of New York to issue corporate stock of said city for the purpose of paying to the relator certain sums of money due him under a contract between himself and the mayor, aldermen and commonalty of the city of New York, to the obligations of which the present city of New Yorlc.had succeeded, The writ of mandamus was duly served on the respondent Brice, as well as on
