Appeal from a judgment of Onondaga County Court (Fahey, J.), entered January 25, 2001, convicting defendant after a. jury trial of, inter alia, attempted murder in the second degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by directing that all sentences shall run concurrently and as modified the judgment is affirmed.

However, inasmuch as defendant was sentenced to determinate terms of incarceration for the attempted murder and assault counts, the court erred in sentencing defendant to a consecutive term of incarceration for criminal use of a firearm in the first degree (see,
