Upon granting plaintiffs’ motion for reargument of the prior summary judgment motion of defendant Loomis-Root, Inc. (Loomis-Root), the court should have granted in its entirety plaintiffs’ motion. Thus, in addition to reinstating the cause of action that alleged that Loomis-Root was liable as a distributor of the product under the doctrine of strict products liability, the court also should have reinstated the cause of action that alleged that Loomis-Root was negligent in maintaining and servicing the product. Therefore, we modify the order entered upon reargument by granting plaintiffs’ motion in its entirety. (Appeals from Order of Supreme Court, Erie County, Gorski, J.—Summary Judgment.)
