Reversing.
Appellant was convicted of knowingly selling Jamaica ginger for beverage purposes, and the insufficiency of the evidence is the principal ground urged for a reversal of the judgment. Jamaica ginger is one of the articles included in section 2554a-26, Kentucky Statutes, 1924, and the statute makes it an offense knowingly to sell such article for beverage purposes, or to sell same under circumstances from which the seller might reasonably deduce the intention of the purchaser to use it for such purpose. Judgment reversed and cause remanded for a new trial consistent with this opinion.
