It is ORDERED: Based upon the settlement, DEFENDANT’S MOTION TO DISMISS AND MOTION FOR SUMMARY JUDGMENT [Docket No. 74 , Filed May 26, 2010] is deemed MOOT and is DENIED WITHOUT PREJUDICE.
