The petitioner seeks a peremptory mandamus order requiring- the respondent Frank Mann, as tenement house commissioner, to receive, consider, approve and pass the plans filed by the petitioner for the erection upon her premises, situate at the northeast corner of Fifth avemie and East Seventy-third street, in the borough of Manhattan, city of New York, of a tenement house or apartment building to approximately the height of 150 feet above the curb, and to compel him to issue a permit for the erection, construction and completion of said building.
