Ramos, J.), entered May 20, 2003, which, upon the prior grant of plaintiffs motion for summary judgment in lieu of complaint, pursuant to CPLR 3213, awarded plaintiff damages in the principal amount of $57,500,000, unanimously affirmed, with costs. Appeal from the underlying order, same court and Justice, entered on or about May 12, 2003, unanimously dismissed, without costs, as subsumed in the appeal from the ensuing judgment.
