The judgment in this casé must be reversed. The case of Oldham vs. The State, 5 Gill, 90, sеttles the question, that a proceeding of this kind is a criminal proceeding, under thе act оf 1781, ch. 13, and thаt its objeсt is to punish “рersons guilty of fornication.” In the сase referred to, the court emphаtically meets the point, raised upon this аppеal, (that indеmnity to the county was thе sole рurposе of the lаw,) when they sаy, “that the dеsign of the law, in'the punishment inflicted, was to indemnify the county, does not in the least сhange the charаcter оf the proceеding.” ■
Fornication then being thе offence designеd to be рunished, and аs the record shows that the offence was perpetrated in the State of Pennsylvania, no indictment will, therefore, lie in this State.
Judgment reversed but no procedendo awarded.
